A process server hands you a stack of papers, and it’s tempting to set them aside until you feel ready. With a debt lawsuit summons, that pause can cost you more than the debt itself, because the window to respond is short and what follows is hard to undo.
In Texas, Your Summons Is Called a Citation
Texas courts call a debt lawsuit summons a citation. It names the court and the date your answer is due. The deadline depends on the court:
District and county courts: Under Rule 99 of the Texas Rules of Civil Procedure, your answer is due by 10:00 a.m. on the Monday after 20 days have passed since you were served.
Justice courts: Your answer is due by the end of the 14th day after service, or the next business day if that day falls on a weekend or holiday.
The clock starts when you’re served, not when you open the envelope.
What Happens If You Do Nothing?
If no answer is filed in time, the creditor can ask for a default judgment. The court can then rule without hearing your side. As the Consumer Financial Protection Bureau explains, that judgment usually covers the amount claimed plus allowed interest, fees and attorney fees.
Calling the collector doesn’t stop this; only a filed answer does. Once a judgment is signed, the creditor gets stronger tools, such as a lien on non-exempt property or a freeze on bank account funds. Undoing a default is possible in limited cases, often with help from a judgment defense attorney, but it’s far harder than answering on time.
Why Answering on Time Protects Your Rights
Filing an answer doesn’t admit that you owe the money. It makes the creditor prove its claim, which is where any debt lawsuit defense begins. The Federal Trade Commission notes that a collector must show the debt is yours, the amount is correct, and it’s the party entitled to collect.
Debts are often sold, and the paperwork doesn’t always follow them. Responding to a debt lawsuit summons on time keeps your chance to question the balance, point out that a debt is too old to sue on, or negotiate from a stronger position. Good lawsuit defense depends on that one filing.
Where Bankruptcy Fits In
Filing for bankruptcy starts an automatic stay that generally pauses collection lawsuits already underway. If a judgment is already in place, bankruptcy may also discharge it when it comes from ordinary consumer debt. Still, don’t let the deadline slide while you decide, since a creditor lawsuit lawyer can file your answer while you weigh it. Money problems tend to grow the longer they wait, which is why ignoring financial problems makes them harder to resolve.
